He accused of killing Henry Gerckens in 1897 in Petaluma, Sonoma, CA.78265 He shot Henry Gerckens on 1 Mar 1897. The coroner's inquest determined that the gunshot wound was accidentally inflicted. One of the witnesses was George V. Temple, who must be related to Farley and may be the Valentine Temple buried in Petaluma.
The Petaluma Daily Morning Courier for 3 Mar 1897 noted that, at the funeral of Henry Gerckens, Conrad Tempel sent a "large pillow, with the name 'Henry' beautifully inscribed."
The killing was described as an accident in the same newspaper on 1 Mar 1897:
"A Terrible Accident
"Little Henry Gerckens Instantly Killed by a Playmate While the Boys were Playing with a Pistol.
"One of the most horrible accidents in the history of the city shocked people shortly after 2 o'clock Sunday afternoon, and a gloom was cast over the quiet Sabbath when the sad news was spread broadcast of the accidental killing of Henry, the eldest son of Mr. and Mrs. J.H.L. Gerckens, a lad aged eleven years.
"There was great excitement, and hundreds of people crowded the street in front of Tempel's store, where the accident occurred, so that for a while it was impossible to secure the details of the affair, and the air was rife with stories.
"It seems that five little boys were playing in Mr. Tempel's store, the front door being locked at the time. They were Farley, the sixteen-year-old son of Conrad Temple, Henry and Fritz Gerckens, aged eleven and nine, Charlie White, aged thirteen, and little Francis Horn. The stories of the children are conflicting, but Charlie White and Fritz Gerckens tell the same tale.
"They say that they had been playing in the store as they often did on Sunday when it rained. Farley had a pistol, so they started to play robber, young Tempel was to be the storekeeper, Henry Gerckens was the robber, and Charles White the policeman.
"Tempel was behind the counter and Gerckens started to sneak around when the 'storekeeper' said 'Stop, or I'll shoot.' He snapped the pistol at him twice and the third time there was a flash and report and little Henry fell forward on his face. 'I'm dying, Fritz,' he said to his little brother, as a stream of blood saturated his throat and clothing.
"Instantly there was great confusion among the children, and they ran here and there in their excitement. John S. Blackburn was standing in front of the post office which adjoins Tempel's store and, hearing the report, thought the boys had a bomb. Going to the door the terrified children rushed out and in a second he comprehended the situation. Rushing to the prostrate by Mr. Blackburn tore his clothing apart and made an effort to stanch the awful flow of blood. The little sufferer tired to speak but could not be understood by Mr. Blackburn, who put his ear close to the boy's mouth.
"Dr. French was by this time at the scene and Drs. Schumann, Reed and Ivancovich, who had been summoned by different ones, also arrived quickly. But the lad had passed away in five minutes after the fatal shot was fired.
"The mother and father and Mr. and Mrs. Tempel arrived before the child died, and the scene was a heart-rending one. The dead body was carried to the Western Hotel just around the corner, and placed in the parlor on the second floor.
"Little Farley Tempel tried to send one of his playmates for a policeman, but they were afraid to go, so getting his hat, he found Constable Connell on Washington Street and manfully told his story, and asked to be arrested. The constable hunted up Judge Scudder and as a matter of form the boy was charged with manslaughter. He was released on bonds placed at $2,000, with J.M. Palmer and J.V. Long as sureties. Coroner Young was soon after notified by telephone.
"J.V. Long was in the post office adjoining, when he heard the shot, but paid little attention to it until he heard someone cry for water and a doctor. He arrived on the scene shortly after Mr. Blackburn got there, and did what he could for the boy.
"The pistol with which the shooting was done was an American Bulldog of 44-calibre, and had been in the possession of the boy for some time. The ball entered just above the center of the breast bone and flattened there, severing the main arteries from the heart. Death was caused by suffocation due to internal hemorrhage, and was painless.
"The deceased lad was a native of Petaluma, and was a bright, manly little fellow, who had just commenced to assist his father at the Western Hotel, which the latter conducts.
"Farley Temple is sixteen years of age, but looks much younger. He, too, is an industrious little fellow, and for some time has been the local agent for the Bulletin. He has quite a business tact for a child, and has always been a good boy. He keenly feels his sad position, while his parents are almost prostrated by the sad affair. Mrs. Temple [sic], whose health is never good, is in such condition as a result of the blow that she is under the care of a physician. The Tempel family share with Mr. and Mrs. Gerckens the sympathy of the entire community.
"The funeral of the dead boy will be held from the Western Hotel Tuesday at 1:30 p,m. and the interment will be at Cypress Hill.
"The Inquest
"Coroner Thomas Young came down from Healdsburg this morning, empaneled [the jury] and after the jury had been sworn and the body had been viewed, adjourned to the city hall where the inquest was held.
"Attorney F.A. Meyer appeared in behalf of Tempel at the inquest and took no active part in the questioning of the jury.
"J.H.L. Gerckens, father of the dead boy, was the first witness, and testified that deceased was his son, was a native of Petaluma, and would have been eleven years old next June. His son and Farley Tempel were good friends; they played together and were playmates, but he (Gerckens) was always afraid of the pistol owned by Tempel. He then narrated his learning of the accident, and the death of his son soon after. He had heard that Farley Tempel carried a pistol but never saw it himself.
"Little Fritz Gerckens, broth of the deceased, aged nine years was then called, and testified to the killing. He said the five boys were playing robber in Tempel's store Sunday afternoon. Tempel snapped the pistol at Charley White, but it did not explode. He then snapped it twice at Henry Gerckens, it going off the second time he snapped it and hitting the boy. Tempel was behind the counter. The witness and Francis Horn were sitting down watching the boys play. Deceased was about five feet from Tempel when he shot was fired.
"Witness never saw pistol, doesn't know where Tempel got it. The boys had been playing a while when witness arrived at the store. The boys had no fight, were not angry with each other, but merely playing.
"J.S. Blackburn was then sworn and testified to facts which corroborated the statements printed above. He knows Farley Tempel, and he bears a good reputation. Did not know him to carry a pistol. Saw the pistol in the boy's hand but did not examine it.
"Farley Tempel when put on the stand told his story. With Charley White and Henry Gerckens and other boys he was playing robber in his father's store Sunday afternoon.
"Said he,, 'Charley White was sitting at the desk writing; Henry Gerckens came up to me and asked for some tacks. I gave him a package which he put in his pocket when I turned around to get another package. Then he ran. I pulled the pistol out of my pocket, and snapped it at his head. Did not know the pistol was loaded. Had no quarrel with Henry. We were all laughing and playing at the time, He was a playmate of mine for a long time. had played robber often before in the store on Sundays and especially when it rained. Didn't want to hurt the deceased. Only carried the gun three times and that was when I went out in the he country hunting and shooting at trees. Had the pistol Sunday because I kept it locked up in the store.
"Little Francis Horn was next called and corroborated the story told by Fritz Gerckens, and signed his name to the statement.
"Charley White, the last of the unfortunate quintette, further confirmed the story told by the other boys on the stand.
"The coroner asked the members of the jury if they were satisfied that the shooting was accidental and he was informed by Juror Maddalina that the jury would like to see the pistol with which the boy was killed. Mr. Tempel went after it and returning shortly, exhibited it to the jury. It was not a Bulldog, but an old style, 5-shot, single action, rim-fire revolver of 44 calibre. The jurors examined it closely.
"Farley Temple was then recalled and testified that he did not take aim when he shot. When the pistol went off it was not in his hand, having fallen from his hand to the counter, by his slipping as he turned around. He never had the pistol loaded, and though there was no cartridge in it. The pistol belonged to his father, who did not allow him (Farley) to carry the pistol if he knew it.
"The coroner then handed the jurymen a blank form showing that deceased had come to his death by gunshot would at the hand of Farley Tempel, and exonerating Tempel from all blame. After several jurymen had signed it the other said they wanted to retire and deliberate before returning a verdict and the jury thereupon retired.
"After the Jury had been out some time, the coroner was called for, and later Mr. Tempel and his son called for and questioned. After being out for over an hour the jury returned with the following verdict which was signed by all of jurors except A. Maddalina, who for reasons not given, refused to sign it:
"'We, the jury, find the deceased, Henry Ludwig Gerckens, a native of Petaluma, aged eleven years, cane to his death by a gunshot would, inflicted by one Farley Tempel, accidentally. We further exonerate Farley Tempel from all blame. We further strongly reprimand his father for permitting his son to carry and use firearms.'
"The case against the young man will now be dismissed by the district attorney. The examination has been set for Wednesday morning at 10 o'clock, when District Attorney Seawell, after inquiring into the matter will probably dismiss the case."
